In a legal world where family, finance, and emotion are tightly intertwined, few lawyers manage to blend sharp legal acumen with deep human understanding. Shruti Swaika, Advocate with 15+ years across estate planning, civil & corporate litigation, insolvency, real estate, and restructuring, stands among that rare group. A fifth-generation member of a Marwari business family and a first-generation lawyer, she brings a nuanced 360° perspective to some of the most sensitive legal assignments in India.

On this special Ganesh Chaturthi edition of the Law, Legacy & Leadership series at Koffee Conversation, Shruti opens up about navigating complex family dynamics, guiding clients through emotionally charged decisions, balancing litigation with advisory work, and shaping conversations around succession in a rapidly changing India. She is articulate, empathetic, and grounded — a lawyer who represents both heritage and modernity with striking grace.

Shruti’s entry into law was not pre-planned — it was one of several academic paths until Symbiosis Law School happened, nudging her into a profession where she soon found her voice. Growing up in a business family gave her a close view of how disputes originate, how legacy gets built (or broken), and why estate planning matters long before succession becomes a crisis. Over the years, she evolved into a multidisciplinary practitioner — equally comfortable before courts as she is structuring wills, trusts, and family settlements.

Her 13-year tenure with Fox & Mandal exposed her to massive estate-related litigations worth thousands of crores, shaping her ability to anticipate disputes before they arise. Insolvency work strengthened her understanding of how quickly wealth can unravel, and advisory work taught her the art of gentle but firm client communication. Today, she also serves as an Independent Director on respected boards — offering clarity, external perspective, and risk-aware decision-making to corporate leaders.

Key Highlights of the Koffee Conversation with Shruti Swaika:

  • Estate planning requires a judgment-free space, patience, and conversations that go beyond paperwork.
  • Clients aren’t stubborn — they simply need their concerns translated into workable legal structures.
  • Advises only making a will when necessary; probate requirements can burden families if goals align with default law.
  • Pets can be provided for through caregivers and funds — the real challenge is finding trustworthy handlers.
  • Perception of estate planning has shifted — even smaller families now seek clarity and transparency.
  • Women today are driving succession conversations within families with more confidence.
  • Insolvency work taught her how fast wealth can unravel — influencing how she structures protection mechanisms.
  • Litigation and advisory coexist seamlessly because both require discipline, scheduling, and clarity.
  • Lawyers bring external perspective to boards — seeing risks and structures beyond business silos.
  • Key skills for any lawyer: listening, clear communication, adaptability, and deep legal reading.
  • AI is useful for speed but cannot replace the human intellect required for nuanced legal judgment.
  • Inspired by generational wealth advisors like James E. Hughes for holistic legacy thinking.
  • Believes India lacks a comprehensive 360° estate-planning text — hints at co-authoring one in future.
  • Personal rituals: planning the next day in advance to stay focused and productive.
  • Describes herself as stubborn, impatient, and deeply caring — a blend that reflects passion with purpose.
